Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Scando mobile application and website (the "Service") operated by Scando ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use Scando. By using the Service, you represent and warrant that you meet this requirement. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Promptly update your information to keep it accurate.
• Notify us immediately at support@joinscando.com of any unauthorized use of your account.
• Not share your account credentials with any third party.

We reserve the right to terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use Scando only for lawful purposes and in a manner that does not infringe the rights of others. You may not:

• Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other harmful code.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Scrape, crawl, or use automated means to access the Service without our express written permission.
• Use the Service to send unsolicited communications (spam).
• Violate any applicable local, state, national, or international law.

4. User Content

You retain ownership of content you post to Scando ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to post your User Content.
• Your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
• Your User Content complies with these Terms and all applicable laws.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion and without notice.

5. Climbing Safety Disclaimer

Climbing is an inherently dangerous activity. Scando provides a platform for logging climbs and connecting with other climbers but does not provide safety advice, training, or supervision. You are solely responsible for your safety and the safety of anyone climbing with you. Always follow proper safety protocols, use appropriate equipment, and climb within your ability. We are not liable for any injury, death, or property damage arising from your climbing activities.

6. Intellectual Property

The Scando name, logo, app design, and all content created by us (excluding User Content) are the exclusive property of Scando and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

7. Third-Party Services

The Service integrates with third-party services including Supabase for backend infrastructure. Your use of such services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCANDO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless Scando and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time from within the app settings. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
